Freehold Alimony Lawyer

Experienced Advocates Who Will Protect Your Rights

Few issues in family are subject to so many misconceptions and so much emotion as alimony. Also referred to as spousal maintenance or spousal support, the payment of alimony is not always required in every case. When it is required, alimony may be subject to termination or modification as circumstances warrant. In many cases, the spouses may even opt out of alimony in lieu of a property settlement.

At the Law Offices of James M. Newman and Associates, LLC, we have extensive experience in all matters relating to alimony. We understand the many legal, financial and tax issues surrounding this issue, and we use our experience to achieve the best possible outcome for our clients.

Alimony in New Jersey

New Jersey family law specifies three types of alimony:

  • Rehabilitative alimony — Paid until a set date or the achievement of a goal such as education or training, which can enable the receiving spouse to support her or himself.
  • Term alimony — Paid until a set date, after which it terminates.
  • Permanent alimony — Paid without a termination date, or until the receiving spouse remarries or dies.

New Jersey Long-Term/Permanent Alimony Attorneys

Courts will mandate alimony in cases involving long-term marriages or when one of the spouses is disabled and cannot support himself or herself. Since alimony is tax deductible for the payer and taxable for the receiver, it may make sense to opt instead for a particular property settlement. Our lawyers can review your situation and explain your options.

Even though the alimony may be "permanent," the payment amount does not have to necessarily stay the same over time. Our firm can go to court seeking a modification in alimony for you.
