Equitable Distribution and Property Division

The term "equitable distribution" is often misunderstood as being "equal division." In fact, equitable means what is fair, not what is equal. This fairness stems from a number of factors regarding your marriage, including the length of your marriage, whether one spouse supported the other through school or job training, and whether one spouse stayed home to raise children while the other worked.

Regardless of your circumstances, all marital property and debts will be reviewed and distributed between you and your spouse. This can include a distribution of:

  • Other real estate
  • Cars and other vehicles
  • Household furnishings
  • Bank and savings accounts
  • Retirement accounts, pensions and 401(k)s

  • Mortgage debt
