Obtaining a Restraining Order
If you or your children have been subjected to domestic violence or threats of violence, you need to take action.
The first thing you should do is obtain a temporary restraining order. You can obtain this yourself during business hours at Superior Court. On evenings or weekends, you can obtain a temporary order from a Municipal Court judge.
This temporary (or ex parte) order is valid for 10 days. You will receive notice of a hearing for the final (or permanent) order within that period. Our New Jersey domestic violence attorneys can represent you in this hearing. We will present evidence supporting your need for the permanent order, including the need for specific conditions in the order if those should be necessary. Once issued, the final order is permanent, unless it is removed in a subsequent hearing.
Have You Been Served With a Temporary Restraining Order?
If you have been accused of domestic violence, your rights are in grave danger. If a final order is issued, you will be forced to stay away from your home and you will lose your right to own a firearm. The court will assume that your child custody and visitation rights should be taken away, unless you can show otherwise in a legal proceeding, which could be long and difficult.
Our firm can represent you in the civil hearing regarding the permanent order. This will be a full evidentiary hearing, where we can present evidence and cross-examine witnesses. Our goal will be to prevent the issuance of the order. Alternatively, we can seek a civil restraint. With this outcome, you agree to certain ground rules regarding the contact you can have with the other person. Your name will not be entered into the domestic violence database, and you may be able to retain your visitation rights.
